General Terms and Conditions

Article 1 – Definitions
The following terms are used in these general terms and conditions:

  • Cooling-off period : The period within which the consumer can make use of the right of withdrawal.
  • Consumer : The natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
  • Durable contract : A distance contract relating to a series of products or services, the supply and/or purchase obligation of which is spread over a certain period.
  • Right of withdrawal : The possibility for the consumer to cancel the distance contract within the cooling-off period.
  • Entrepreneur : The natural or legal person who offers products or services remotely to consumers.
  • Distance contract : A contract concluded between the entrepreneur and the consumer within the framework of an organised distance selling system, whereby exclusive use is made of one or more techniques for distance communication.
  • CESOP : The Central Electronic System for Payment Information, introduced by the EU to monitor payment service providers.

Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded. Before the contract is concluded, the conditions will be made available electronically or otherwise.

Article 4 – The Offer
All offers are without obligation. The entrepreneur reserves the right to change offers.
The offer clearly states the total costs, including shipping costs, import duties and any additional costs charged by the postal or courier service.

Article 5 – The Agreement
The agreement is concluded as soon as the consumer accepts the offer and meets the conditions set. The entrepreneur confirms the acceptance immediately by e-mail.

Article 6 – Right of withdrawal
The consumer has the right to withdraw from the agreement within 14 days after receipt of the product without giving reasons.
The return costs are for the account of the consumer when using the right of withdrawal.

Article 7 – Costs in case of withdrawal
The entrepreneur will reimburse the payments within 14 days after withdrawal, provided that the product has been returned in its original condition.

Article 8 – Customs and VAT regulations
The customer is responsible for complying with all legal obligations regarding the import of goods in the country of delivery, including taxes and customs charges.
The entrepreneur does not act as an importer of the goods.
The customer must satisfy himself/herself of the local import and usage regulations of the purchased goods.
All additional costs for customs clearance, such as administrative costs, are entirely for the account of the customer.
The entrepreneur provides the necessary documentation for shipment, but does not guarantee that the goods meet local import requirements.

Article 9 – CESOP Compliance
From 2024, payment data will be registered in the CESOP system (Central Electronic System for Payment Information) according to EU regulations. The entrepreneur complies with these regulations, which may affect the monitoring and reporting of payments.

Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products comply with the agreement and the legal requirements.
Complaints about defects must be reported in writing within 14 days.
Products must be returned in their original packaging and undamaged.

Article 11 – Delivery
Orders will be delivered within 30 days, unless otherwise agreed.
In case of delay, the consumer will be informed within 14 days after ordering.
Orders are shipped under conditions where the customer is the recipient and responsible party for any import procedures.
The entrepreneur ensures correct shipping but is not responsible for customs delays or problems.
Non-compliance with import obligations by the customer does not constitute a reason for cancellation or refund of the order.

Article 12 – Complaints handling
Complaints must be reported in writing within 7 days of discovery.
The entrepreneur will respond to complaints within 14 days. If a longer processing time is required, an indicative term will be given.

Article 13 – Disputes
These general terms and conditions are governed by Dutch law. Disputes are preferably resolved by mutual agreement. If necessary, disputes will be submitted to the competent court in the Netherlands.
